Estonia has taken a number of steps to prevent and combat trafficking in
human beings. The national legal
framework related to combating human trafficking has evolved over the years, in
the light of the country’s international commitments. The offence of
trafficking in human beings was introduced in the Criminal Code (CC) in 2012.
In order to be fully consistent with the definition of trafficking in human
beings in the Convention, GRETA urges the Estonian authorities to add to the
definition of human trafficking under Article 133 of the CC the component of “action”,
to ensure that all the “means” provided for in the Convention are adequately
reflected, and to include forced labour or services, slavery or practices
similar to slavery, servitude and the removal of organs among the forms of
exploitation. Further, GRETA asks the Estonian authorities to ensure that the
criminalisation of trafficking in children fully reflects the provisions of
Article 4 of the Convention.
